Probate is the process by which the court appoints a personal representative (executor) to settle the affairs of a deceased person. Guardianship proceedings appoint a guardian for an incapacitated adult to make life and medical decision for that person when they are not competent to make their own decisions. In the case of a minor child, a guardian would be appointed if no adult parent is available.
